MyDaily's Kim Kyungmin, is Jaebum obligated to clarify?
The side that is accusing the other of such a crime is the one that needs to submit proof.

Today, I saw on the main page of portal site Nate's news feed an article titled, 'Jaebum, he needs to clarify his mistakes before he returns.' To me, he is a senior journalist, but I feel that before journalist Kim Kyungmin asks Jaebum to 'clarify,' I need to ask him, is Park Jaebum obligated to answer to such claims?

The start of the controversy was with JYPE's announcement about Park Jaebum's private life. Although JYPE claimed that they were not able to reveal the details in order to protect him, just the words 'severe private life' was enough to bring about thousands of speculations and hateful replies amongst the netizens, resulting in a tarnished image to Jaebum's name. And regarding the severe private life, JYPE never revealed it.

But just because JYPE never revealed it, does Park Jaebum have to respond? It might be a jump of logic but I will attempt to use an example from law. In Korea, the principle of criminal procedures is the prosecutor's burden of proof. What this means it that the side that submits the proof is the side that is accusing the other of such claims. It's common knowledge.

For example, let's say that somebody speculated, "MyDaily's journalist Kim Kyungmin wrote the article after receiving a sum of money from JYPE." Will the police go to journalist Kim Kyungmin and ask, "You received money from JYPE, right? Give me proof that you didn't." The only response that Kim Kyungmin can give in this situation is that he did not receive anything. There is no way to prove this. Then, for the reason of not being able to prove that he did not receive money from JYPE, should he go to jail?

This is the same. If JYPE reached a situation where they had to reveal the details of the 'severe private life,' the side that must submit proof is JYPE, not Park Jaebum. For journalist Kim Kyungmin to ask Park Jaebum to clarify his mistake before returning as an artist is extremely wrong. And for me personally, I believe that Park Jaebum's communication with his fans and participating in an album and movie production is his own way of responding to JYPE's 'private life' claims. I believe that he is showing us that he is still working hard, still taking care of himself, and that he is alive and well.

If Park Jaebum truly did have a severe private life that did not allow him to participate in activities, the one that must reveal that is JYPE. However, if the true nature of the mistake is not a 'heavy and immortal mistake' but rather closer to a 'personal attack,' then it is only morally right for the issue to never be revealed. I, too, am highly curious of the severe private life that JYPE has stated. But I also believe that it is not right to conduct such media play by continually asking him, "Did you do it? Did you not? If you didn't, show us proof," which is why I'm writing here today.

PS. The point of this post is not to decide whether or not Park Jaebum has a severe private life. His private life is, literally, his private life. If the issue is not punishable by law, the nation has no right to know.

It seems as if those with the right to remain silent in our nation are extremely limited, and most often exploited by those higher in position and power.
